Rules of visiting and conduct in the Hello Park multimedia amusement parks
The legal entities operating under the Hello Park brand (, ), hereinafter referred to as “Hello Park”, offer any legally capable individual and/or sole trader and/or authorised representative of a legal entity, hereinafter referred to as the “Guest”, who wishes to use or uses the services of Hello Park when visiting any of the Hello Park parks — hereinafter referred to collectively as the “Parks” and each individually as the “Park” — to enter into a contract for the provision of services for a fee (hereinafter — the Contract) on the terms of, and subject to full and unconditional compliance with, these Rules.
The Guest’s implied action, expressed in the purchase of a Hello Park entrance ticket, expresses the Guest’s will to accept the terms of the Contract and the Rules, as well as the fact that they have fully read and agreed to them. The relations between the Guest and Hello Park are governed by applicable law, including articles 436 and 437 of the Civil Code of the Russian Federation.
The rules for visiting a Hello Park park, as regards visits to the Hello Park café, are also governed by Decree of the Government of the Russian Federation No. 1515 of 21.09.2020 “On approving the Rules for the provision of public catering services”.
In accordance with clause 4 of the above Decree: “The provider (Hello Park) has the right to establish on its own, at the places where services are provided, rules of conduct for consumers that do not contradict the laws of the Russian Federation (restriction of smoking, prohibition of being present in outerwear and others)”.

- TERMS AND DEFINITIONS
1.1. Administration or Administrator — employees or an employee of Hello Park and/or employees or an employee of third parties providing services and/or selling goods in the Park under the relevant contracts, who are authorised to take decisions by virtue of their job duties, including but not limited to: the Manager, the Park Manager, the Administrator-Cashier, the Banquet Sales Manager, the barman, the waiter, the operator;
1.2. Guest — means any individual who wishes to use and/or uses the services provided by Hello Park in the Park, including:
1.2.1. Infant — means a minor individual whose age at the time of visiting the Park is from 0 to 1 year inclusive;
1.2.2. Child or Children — means one or more minor individuals whose age at the time of visiting the Park is from 1 to 18 years inclusive;
1.2.3. Adult or Adults — means one or more legally capable individuals of full age, and also, in the cases established by law, legally capable individuals who are minors;
1.2.4. Accompanying person — means an Adult who is a legal representative authorised by law or on other lawful grounds to bear responsibility for the Infant, Child and/or Children whom they accompany when visiting the Park;
1.3. Order — an agreement between the Purchaser and Hello Park under which Hello Park undertakes to provide the Purchaser and/or other persons named by the Purchaser in the Order with Party services, and also to provide additional services, within the time frame and to the extent set out in the Order and these Rules, while the Purchaser undertakes to accept and pay for the services provided by Hello Park in accordance with the terms of the Order and these Rules;
1.4. Play Area — means the area of the Park intended for active play, in which the Play Elements and the multimedia space are located. The play area has a carpet floor covering.
1.5. Play Elements — parts of the Park intended to be used by Guests for play activities in accordance with these Rules. A non-exhaustive list of the Play Elements and the conditions for their use is set out in article 7 of these Rules. The presence in every Park of the Play Elements listed in article 7 of these Rules is not guaranteed, and the configuration and/or dimensions of a given Play Element may also differ between Parks;
1.6. Party Rooms — specially equipped rooms located within the territory of Hello Park and made available to Guests of the Park for holding Parties, on the terms established by these Rules;
1.7. Parks or Park — the Hello Park multimedia parks, including the play area, the multimedia space, virtual reality and the Hello Park café. The Hello Park café is a public catering establishment located within the territory of the park or outside it.
1.8. Purchaser — means a legally capable individual or a legal entity paying for the goods and/or services provided by Hello Park in the Park, including but not limited to: the purchase of entrance tickets, payment of the price of an Order for holding a Party, payment for the dishes and drinks sold in the Park’s café;
1.9. Party — means a group event for a limited number of people, such as birthday and graduation celebrations, held in a specially designated room of the Park and/or a place in the café area of the Park, during the period of time established in the Order, with Hello Park providing the minimum set of services included in the Party service under these Rules, as well as additional services agreed separately in the Order.
2. GENERAL PROVISIONS
2.1. These Rules apply to all Guests present in the Park, without exception.
2.2. By purchasing a ticket to visit the Park, Guests agree to these Rules and also to the rules for using the Play Elements, which are displayed on special signs next to the Play Elements and the multimedia space.
2.3. In the event of a breach of the rules for using the Play Elements (including a breach of the restrictions on age, weight, height or the number of users of a Play Element) set out in these Rules and/or on the information signs, all responsibility for the possible consequences and injuries lies with the Adult and/or the person Accompanying the Child/Children who committed or allowed the breach of these Rules.
2.4. Hello Park is not responsible for accidents arising as a result of Guests breaching these Rules or generally accepted precautions.
2.5. If Guests breach these Rules, and also in the event of inappropriate behaviour by Guests (aggression, creating a risk of harm to the health, property or life of third parties), the Administration has the right to end the Guests’ stay in the Park early, and the price of the tickets is non-refundable.
2.6. From time to time Hello Park has the right to amend these Rules unilaterally by displaying the approved version of the Rules in the consumer information corner and at the ticket desk at the entrance to the Park, and also by publishing the approved version of the Rules on the website at the permanent internet address: https://hello-park.kz/kaspiysk
2.7. Hello Park may carry out video and photo recording of visitors within the territory of the Park.
3. PARK OPENING HOURS
3.1. The Hello Park multimedia park is open to its Guests: Mon 13:00 — 22:00; Tue–Sun 10:00 — 22:00. The Hello Park multimedia park has no breaks or days off, except for breaks arising for technical reasons and days off set by the Park Administration or by the administration of the shopping and entertainment centres in which the Hello Park parks are located.
3.2. Information about the opening hours of each Park is available at the entrance to the Park. Information about the Park’s opening hours may also be published on the official website of the Park.
3.3. The Park Administration has the right to change the Park’s opening hours.
4. AGE OF GUESTS
4.1. The Hello Park multimedia park is designed for Guests of any age and composition.
4.2. The recommended age of visitors for playing on the Play Elements is from 2 (two) to 12 (twelve) years. Detailed information on the use of each Play Element is set out in Section 7 of these Rules.
4.3. The Park has individual Play Elements with restrictions on the age and weight of the Guests using them and on their number. In such cases the information on the information signs for each Play Element takes priority.
- TICKETS AND PAYMENT FOR VISITING THE PARK
5.1. Tickets to the Park are sold only to Adults or Purchasers. In this connection:

The number of tickets to the Park may be limited by Hello Park.

The Park Administration reserves the right to ask the Purchaser for an identity document to confirm the Purchaser’s age. If no such document is presented, the Park Administration has the right to refuse to sell the Purchaser a ticket.
5.2. Infants visit the Park free of charge together with an Accompanying person.
5.3. Accompanying persons enter the Park in accordance with the price list.
5.4. Adults may enter the territory of the Park without Children only for the purpose of viewing the Park and accompanied by the Administration; using the Play Elements is prohibited in this case. Adults may visit the café area of the Park without Children as well, provided that these Rules are observed.
5.5. Before entering the Park, the Purchaser buys an entrance ticket at the corresponding rate at the Park’s ticket desk or online. Together with the ticket, the Visitor is issued a wristband corresponding to the rate purchased. When buying a ticket, the Guest must complete a consent to the Park Rules and to the processing of the Guest’s personal data (hereinafter — the Consent), which may be given either as a paper document or electronically via self-service terminals. The prices of entrance ticket rates are those stated in the price list approved by Hello Park in the Park itself. A ticket is bought for each Child.
5.6. One ticket (wristband) admits only the one Child for whom the ticket is bought.
5.7. The purchase of an entrance ticket (wristband) guarantees the right to enter and stay in the Park on the terms set out in these Rules for the amount of time for which the entrance ticket was purchased. If a Guest stayed in the Park for less time than that for which the ticket was purchased, the price of the visit is not reduced, as stated above, and Hello Park is deemed to have performed all its obligations to the Guest in full. The unused time is not compensated.
5.8. Guests must keep their tickets and receipts until the end of their stay in the Park.
5.9. When buying a ticket at a short rate (all rates except the unlimited ticket), Guests must keep track of the time of their stay in the Park and pay in good time to extend their stay in the Park.
5.10. The start time of the Guest’s visit to the Park is recorded by the cashier on the ticket/wristband and may be checked by the Administration at any time. At the end of the visit the Guest must return the ticket/wristband to the Administration to be cancelled and leave the Park.
5.11. If Guests who have paid for a ticket to the Park at a short rate (all rates except the unlimited ticket) have not left the Park by the time the paid period of stay in the Park expires, the Guests must pay the additional cost of the ticket for the time exceeding that paid for when the ticket to the Park was purchased, in accordance with the Hello Park price list.
5.12. If Guests who have paid for tickets at a short rate of the Park leave the Park before the time paid for when purchasing the tickets has expired, Hello Park is deemed to have provided the services for the use of the Play Elements in full, and the money for the unused time is not refunded.
5.13. Hello Park does not provide childcare or child supervision services and, accordingly, such services are not paid for and are not included in the price of the ticket to visit the Park.
5.14. In addition to what is stated in clause 5.13 of these Rules, the price of tickets to visit the Park does not include the cost of goods and/or services provided by Hello Park in the park for a separate fee, including but not limited to:

food and drinks sold in the Park’s café;

preparing and holding a Party;
-
professional photography and/or video recording;
-
the purchase of photographs and video footage created by the Park’s photographers and camera operators while Hello Park provides its services, including but not limited to: play activities, Parties and other activities of Guests in the Park;

the “Face painting” service;
-
additional table setting (drinkware) and waiting services during a Party.
- RULES OF CONDUCT IN THE PARK
6.1. On entering the Park, Accompanying persons must confirm their consent to using the services provided to them by Hello Park in the Park in accordance with these Rules, by filling in the relevant form or in another way set out in clause 5.5 of these Rules for buying tickets to the Park.
By completing the Consent, Accompanying persons guarantee that the personal data they provide is complete and accurate and bear the risks and consequences of providing inaccurate data.
By confirming their Consent to use the services provided to them by Hello Park in the Park in accordance with this clause of the Rules, Accompanying persons also give Hello Park their consent to the processing of the personal data they provide when giving consent to use Hello Park services.
Hello Park hereby confirms that it processes personal data in accordance with the requirements of Federal Law No. 152-FZ of 27.07.2006 “On Personal Data” and with the Personal Data Processing Policy and the Personal Data Processing Rules approved by the General Director of Hello Park, which the Accompanying person may read on the Park’s information stand and/or obtain from the Administration.
6.2. Out of concern for the health of the park’s Guests, Hello Park strongly advises persons with signs of a cold, an infectious or any other disease that could adversely affect the health of Guests not to visit the Park. The Administration has the right, at its discretion, to refuse admission to the Park to Guests with obvious signs of a cold and/or an infectious disease. If Children show signs of a cold or an infectious disease or an allergy, and also if Children have particular conditions and/or contraindications for taking part in any play activity or using the Play Elements or the multimedia space, the person Accompanying the Child must notify the Administration in writing in advance, before entering the Park. If Hello Park is not notified, all the risks associated with this are borne by the Accompanying person.
6.3. Within the territory of the Park and the Hello Park café it is prohibited to:
a. bring in and use items dangerous to Guests, including but not limited to: sharp and piercing objects, items and substances that are prohibited or restricted in circulation, lighters, matches, and also firearms, limited-effect weapons, air weapons, bladed weapons and other weapons;
b. bring in and use pyrotechnics in the Park, including but not limited to: fireworks, firecrackers, smoke bombs, flares, sparklers;
c. bring in and use any means of self-defence in the Park, including but not limited to: gas and pepper sprays, stun guns, limited-effect weapons;
d. smoke, including electronic cigarettes, smoking mixtures and their equivalents;
e. be in the Play Area as a whole, or on any Play Element in particular, while under the influence of alcohol, narcotics or psychotropic substances;
f. bring in and consume alcoholic drinks brought with you, except in cases separately agreed with the park Administration;
g. bring in and consume narcotic substances;
h. in order to comply with sanitary and epidemiological norms and rules, bring into the territory of the Park (in particular, into the territory of the Hello Park café) food and drinks bought outside the Park, with the exception of dietary food and baby food;
i. bring any food or drinks into the Play Area;
j. bring or lead any animals, insects or other living creatures into the Park;
k. take the property of the Park and its elements outside the Park;
l. allow Infants and Children to be in the Park without an Accompanying person;
m. use physical force against Guests and the Administration, and also raise one’s voice at, scold, insult or harass one’s own or other people’s Children, use obscene language, or damage the property of Guests or of the Park;
n. visit and use the Play Elements in outerwear and shoes, or in accessories whose presence on a child while using the Play Elements could lead to injury or an accident;
o. move around the Play Area on mechanical means of transport (scooters, roller skates, skateboards, Segways, etc.).
6.4. Using the Play Elements in outerwear and shoes is prohibited. Visitors may enter the Play Area only in cotton socks (without shoes) and in clean clothes. The Park Administration has the right to reprimand a visitor and to restrict their access to the Play Area if the conditions of this clause are breached.
6.5. Shoes and outerwear must be left in the lockers at the entrance and within the territory of the Park and in the cloakroom. The Park Administration is not responsible for the safekeeping of Guests’ property and personal belongings.
6.6. Prams, bicycles, scooters and shopping trolleys must be left in the specially designated place at the entrance to the Park. The provisions of chapter 47 of the Civil Code of the Russian Federation on safekeeping do not apply to the relations between the Park and Guests. The Park Administration is not responsible for the safekeeping of Guests’ property.
6.7. Children may not leave the territory of the Park on their own, that is, without the Accompanying person with whom they came to the Park. Accompanying persons must keep track of the movements of the persons they accompany.
6.8. Visitors must treat the Play Elements, props, equipment and other property of the Park with care and, after the end of a play activity, return to the Administration of the Play Element all the props provided for temporary use, as well as the equipment and other property of the Park used during the game.
6.9. Accompanying persons have the right to take photographs and video of the Children they accompany. Photography and video recording in the Park may be carried out only for personal purposes, using non-professional equipment and without other Guests or the Administration appearing in the frame. Photography and video recording with other Guests in the frame is possible only after obtaining their prior written consent.
6.10. The Accompanying person must provide complete and accurate information about themselves and about the Children they accompany.
6.11. The Park Administration does not verify the authority of Accompanying persons in respect of the Children they accompany. The right of Accompanying persons to be the legal representatives of the Children, or their representatives on other lawful grounds, and to bear responsibility for the Children they accompany, is presumed by the Administration. Otherwise, Accompanying persons must inform the Administration in writing that they do not have sufficient authority.
6.12. As provided by clause 5.9 of these Rules, Hello Park does not provide child supervision services, is not responsible for Children present in the Park, whether supervised by an Accompanying person or not, and does not supervise Children. All responsibility for the presence of Children within the territory of the Park lies solely with the Accompanying persons. The Administration is not responsible for accidents that occur as a result of Guests breaching these Rules and generally accepted safety measures.
6.13. In the event of a conflict situation and/or complaints about the operation of the Park and/or the actions of other Guests, the Guest should contact the Administration directly.
6.14. The Administration has physical contact with Children only where this is required by the rules of a Play Element and the scenarios of play activities, and also where assistance is needed.
6.15. Where necessary, the Administration has the right to give Guests first aid, which is not professional medical care, or to call an ambulance, and also informs the Accompanying persons of this. Hello Park provides only dressing and disinfecting materials when treating visitors’ injuries. The provision of any other medicines by Hello Park is not guaranteed.
6.16. Given that the Park, subject to article 5 of these Rules, is a place open to free access, Hello Park has the right, under part 1 of article 152.1 of the Civil Code of the Russian Federation, to use images of Guests obtained during their visit to the Park.
7. RULES OF CONDUCT ON INDIVIDUAL PLAY ELEMENTS
7.1. In order to ensure the safety of Guests, Hello Park reserves the right to restrict Guests’ access to certain Play Elements; in this case Hello Park is deemed to have performed all its obligations in full, and the price of the visit to the Park (of the ticket to the Park) is not subject to reduction.
7.2. Each Play Element is designed to be used by Guests of a certain age, subject to the restrictions set out for that Play Element at its entrance and by these Rules.
7.3. Guests must follow the instructions of the Administration when using the Play Elements and observe the following rules for using the relevant Play Elements (where these are present in a particular Park):
- RULES FOR HOLDING A PARTY
8.1. By placing an Order for a Party, the Purchaser agrees to comply fully with these Rules and confirms that they are aware of the consequences of breaching them provided for by these Rules and by the laws of the Russian Federation, and also confirms that they are aware of, and agree to, the conditions for refunding the paid price of the Order.
8.2. The minimum Party service package includes:

an entertainer’s programme;
-
entrance tickets for 8 children.
8.3. The Party service may also include the provision of a room for 2.5 hours or more, a party table, entertainment and show programmes, a photo session and a cake order, as well as other types of services available as part of a Party, as agreed with the Administration (additional services).
8.4. Conditions for ordering additional services:
-
the entertainment programme, photo session and cake are ordered and paid for no later than 2 days before the date of the Party.
-
the entertainment programme, photo session and cake are ordered and paid for at a strictly defined time.
-
changes to the order for the entertainment programme, photo session and cake may be made no later than 2 days before the date of the Party.
-
changes to the menu on the Purchaser’s initiative are accepted by the Administration no later than one day before the intended date of the Party.
8.5. The Purchaser/Guest has the right to bring their own cake to the Party.
8.6. An Order for a Party is deemed to have been placed once payment of the price of the Party service package and of the price of the additional services (clause 8.4), where ordered, has been confirmed.
8.7. Timing of the Party and the procedure for changing it:

the Party is held during the period of time established in the Order, regardless of the time at which it actually starts, except where the delay in starting the Party is caused by the acts/omissions of the Park.

after paying for the Order, the Purchaser has the right to move the time of the Party to a later date and/or to change the exact time of the Party within the same day without changing its duration, provided that all of the conditions listed below are met at the same time:

there are places available in the rooms or in the café on the date/time requested;
-
the relevant notice of the change of the timing of the Party is received by the Administration at least one day before the intended date of the Party;
-
the change is made by the Purchaser no more than twice within 30 (thirty) calendar days from the date the Order was placed.
8.8. The place where the Party is held is determined by the Administration on its own.
8.9. Conditions for cancelling an Order on the initiative of the Purchaser/Guest and refunding the money paid:
If the Order is cancelled on the initiative of the Purchaser/Guest, the price of the Order paid by the Purchaser, in accordance with article 32 of the Law on the Protection of Consumer Rights:
is refundable less the costs incurred by the Park as at the date of such withdrawal (entertainment programme, photo session), within 3 (three) working days from the date the Purchaser/Guest applies;
8.10. Notification procedure.
• To cancel an Order, call the park by telephone or come to the park in person to submit an application for a refund.
• To change the timing of a Party under an Order, call the park’s contact telephone number.
- LIABILITY
9.1. Accompanying persons must explain to Children these Rules for visiting the Park and using the Play Elements and the multimedia space, as well as the prohibitions and restrictions established. Accompanying persons bear full responsibility for the Children’s compliance with these Rules and for the risks associated with their stay in the Park, and must themselves strictly follow these Rules.
9.2. The Administration has the right to reprimand Guests who breach these Rules and, in the event of a gross breach of these Rules, to refuse to provide the service. If the Administration refuses to provide services, the Guest must leave the Park immediately, and if the Guest refuses to leave the Park, the Administration has the right to call the police to resolve the situation.
9.3. Hello Park is not responsible for Children present in the Park, whether supervised by Accompanying persons or not. All and any responsibility for the state of health of Children, their behaviour and their compliance with these Rules lies with the Accompanying persons.
9.4. Accompanying persons must teach Children order by their own example: observe generally accepted ethical norms and rules of conduct, both towards each other and towards the Administration, keep the premises clean and tidy, and treat the Park’s property with care.
9.5. Hello Park is not liable for harm caused to the life, health or property of Guests where no fault of Hello Park has been established.
9.6. If Guests cause damage to the property of the Park, the Guests must compensate such damage in the amount of its value. The amount of the damage is determined by the Park administration.
9.7. If an accident occurs or there is a danger of one occurring, the Guest must notify the Administration immediately so that the necessary assistance can be given.
9.8. Hello Park is not responsible for belongings left unattended by Guests, or for loss connected with the disappearance, theft or damage of Guests’ personal belongings, including valuables (bags, mobile phones, keys, shoes, etc.), anywhere within the territory of the Park.
9.9. Guests must report any unattended and/or suspicious items they find to the Administration. Guests are advised not to touch or move such items themselves. Items found are kept in the Park for one calendar month. Information about left belongings kept in the Park can be obtained from the Park Administration and by telephone.
9.10. Video surveillance is carried out in the Park to ensure safety.
9.11. The consumption of alcoholic drinks within the territory of the Parks is strictly prohibited. In the event of a breach of this requirement, the Administration has the right to notify the internal affairs authorities of such a breach and to inform the Guest of the consequences of the breach established by article 20.20 of the Code of Administrative Offences of the Russian Federation. The provisions of this clause, and of sub-clause “f” of clause 6.3 of these Rules, subject to Guests complying with the requirements of sub-clause “e” of clause 6.3 of these Rules and with applicable law, do not apply to a Park in which Hello Park sells alcoholic drinks; in any event, however, it is prohibited to bring in alcoholic drinks similar to those sold in the Park.
9.12. Any letters, claims, demands or comments concerning the operation of the Park and/or the Park’s employees must be made in writing and sent to the Hello Park details given in Section 10 of these Rules.
9.13. The time limit for replying to incoming correspondence is 30 calendar days.
